Lawyer Tony Lithur has filed a suit at the Supreme Court on the instructions of a former Deputy Attorney General under the Mahama administration Dr. Dominic Ayine (plaintiff) against the nomination of Mr. Martin Amidu as Special Prosecutor.
According to him, Mr. Martin Amidu at age 66 is not qualified or eligible to be nominated as Special Prosecutor under section 13(3) of the office of the Special Prosecutor act, 2018 (Act 959).
They are also among other things asking that any purported nomination by the Attorney General or approval by Parliament or appointment by his execellency the President of the republic is unconstitutional, and therefore null and void.
Martin Alamisi Amidu, a former Attorney General in the National Democratic Congress [NDC] administration, was named as the Special Prosecutor by President Nana Adoo Dankwa Akufo-Addo.
Mr. Amidu, a man who has earned the nickname ‘Citizen Vigilante’ for his no-nonsense stance and campaign against corruption particularly in the NDC administration, was named by President Akufo-Addo today [Thursday], after an emergency cabinet meeting at the Flagstaff House.
The President in announcing the name, said he received the nomination from the Attorney General Gloria Akuffo, and has accepted the nominee, whose name will be forwarded to Parliament for approval when the House reconvenes from recess.
He is supposed to appear before the Appointments Committee of Parliament on Tuesday the 13th of February, 2018 for his vetting.
It is unclear if this law suit will result in Mr Amidu's vetting being postponed until the final determination of the matter in court.

NPP would have done same if in opposition, let the law take its course. Is it true or not true that one can not occupy that position at the age of 66? politics of the highest, even some NPP members MPs like Ken and others were against Martin Amidu appointment and so these parties are working together to kick him out. Fear politicians.
Hahahaha, Tony Lithur is desperate, he knows that Martin Amidu has unfinished business with him regarding some of his corrupt dealings.

Some Ghanaians forget easily ampa..this is not a matter of law or anythings oo..it is a pure case of envy and politics..Let me remind members here about something that will give you guys a different perspective about this suit...It is this same Lawyer Ayine and co when he was a Deputy Attorney General, who told Ghanaians that the state has no case against Mr Woyome and Mr Amidu proved him wrong...so it is a long battle which is surfacing here..most importantly the Courts cannot prevent Parliament to carry out its duties and besides the matter is not being heard in court yet so the vetting will come on tomorrow..

Indemnity clause was good for the NDC but special prosecutor clause can be sued due to retirement age/ The president knows much about age factors and the court will soon rule on indemnity clause that allows someone to be above the law or and aged career personnel ca still have a job to help Ghana grow........
Democracy is beautiful, so is the Rule of Law. Let the court decide. Of course Nana and NPP knew about the age factor before they went ahead to nominate him!! BEING THE FIRST PERSON IN THE LAW COURT DOES NOT GUARANTEE VICTORY IN THE CASE. In fact it would be unthinkable for NPP to know about his age before settling for him.

NO INSULTS PLEASE.I AM OLD ENOUGH TO REMEMBER WHAT HAPPENED WHEN THE FAST TRACK HIGH COURT WAS FIRST ESTABLISHED. TONY LITHUR AND DR AYINE ARE NO NOVICES IN LAW LIKEWISE MR AMIDU, MISS AKUFFO AND THE PRESIDENT. LETS TAKE OFF OUR POLITICAL LENSES AND TEST OUR LAWS AND IN THAT WAY, OUR DEMOCRACY WILL GROW.
