Management has noted, after considering the reports of the investigation Committee including its findings and recommendations, that you acted disloyally by unilaterally withdrawing the case from the court more especially when the incident occurred in the course of your official duty and Management had written to you and assured you of its support and had specifically instructed you to consult it on any move you wanted to take regarding the case. Management also engaged the services of a legal Officer to assist you in the prosecution of the case. Moreover, you failed to disclose you intention to Management before and after you took your personal decision to withdraw the suit from the court, thus, your actions brought the image of the company into disrepute. This action of yours constitutes gross misconduct and disloyalty under section 22(a) of the collective agreement which should attract summary dismissal. However, Management has given due consideration of the fact that you have shown remorse for your conduct and rendered an apology and has, therefore, decided to apply a lesser penalty. You are, therefore, dismissed with immediate effect with payment of your entitlement under Section 22 (a)(i). The Director-Finance is by a copy of this letter advised to pay your Provident Fund contributions (A&B accounts) with interest less any indebtedness to the company and/or any lending institution which the company guaranteed monthly repayment on your behalf (if any) as soon as possible. Yours faithfully, For and on behalf of GCGL Justice Michael Sarpong Ag Director, HR & Admin
