A Commercial Court presided over by her ladyship, Justice Janapare Bartels-Kodwo has adjourned the case in which three Members of Parliament (MPs) are challenging the 700 million loan acquisition by the Ghana National Petroleum Corporation(GNPC) to December, 11, 2014.
The three MPs suing the GNPC for bypassing Parliament to secure 700 million dollar loan facility are the Deputy Chair of the Public Accounts Committee, Atta Akyea, the Member of Parliament for Manhyia, Matthew Opoku Prempeh, and the Ranking Member of the Finance Committee of Parliament, Dr. Anthony Akoto-Osei.
The Court granted the adjournment sought by Plaintiffs, to enable them file a Supplementary Affidavit and amend their statement of case relative to the supplementary affidavit to be filed.
Counsel for Defendants, Tony Lithur, has expressed his preparedness to respond to the issues in Court.
The case was filed on November 27th, 2014 at the high court and proceedings took off at Commercial Court �A� presided over by Justice Janapare A. Bartels-Kodwo(Mrs) on December, 3,2014.
Lead Counsel for Plaintiffs, Nana Bediatuo Asante, sought an interim injunction to restrain the defendants from taking further steps in pursuit of the $700 million loan it is seeking to raise.
But Lithur opposed it saying,� GNPC as a statutory institution is mindful of its obligations, and believes it has a strong case, and therefore would not do anything to undermine the case.�
The court held that the plaintiffs should wait to be served with the statement of defence and adjourned the case.
