Police Yet To Decide On Prosecution Of Junior Doctors

The 35 junior doctors who picketed at the premises of the Controller and Accountant General’s Department may be dragged before a law court for breaching sections of the Public Order Act.

The Public Relations Officer at the Accra Regional Police Command, ASP Effia Tenge told Citi News, the doctors may be culpable for unlawful assembly.

“If we have to visit the criminal code in the sense that where two or three are gathered with a common purpose, that one can be considered as unlawful assembly, but we have still not decided on what to do with that aspect.”

She however said the Police are yet to sit down to take a decision on the matter.

Explaining the heavy Police presence at the premises of the Controller and Accountant General’s Department, ASP Tenge said it was necessary because one can never underrate the strength of people.

“Look at the numbers here and you can never underrate the strength or power of people who have gathered, so our presence here is only to ensure that people do not breach the law and also take the law into their own hands to cause mayhem or to damage properties,” she explained.

According to her, in every crowd control, there are certain equipment used by the Police to ensure law and order and although she did not see the armoured vehicle and the pepper spray vehicle, “they were all measures that have been devised to ensure that in case people want to endanger lives and destroy properties, we will be in a better position to handle the situation.”

About 35 junior doctors pitched camp at the Controller and Accountant General’s Department to demand the payment of their 11-month salary arrears.

A number of Police personnel were deployed to the area to maintain law and order but after public criticisms, the two armoured vehicles were returned to the Regional Police Command.

Ghana’s Criminal Offences Act 1960 (Act 29) Section 202 states:

(1) Whoever takes part in an unlawful assembly shall be guilty of a misdemeanour.

(2) Whoever takes part in an unlawful assembly armed with any offensive weapon or missile shall be guilty of second degree felony.
