The Supreme Court of Ghana has, by unanimous decision, dismissed a case brought before it by Justices Paul Uuter Dery and Gilbert Ayisi Addo, who were challenging the Judicial Council for withholding their full salaries.
The two High Court judges were implicated in a recent bribery scandal uncovered by ace investigative journalist Anas Aremeyaw Anas.
Following their indictment, the Judicial Council served them notices that they would receive half of their salaries while they were still being investigated in connection with the scandal.
But the two judges sued the Judicial Council and the Chief Justice for the decision to withhold their salaries.
They, therefore, went to the apex court seeking a declaration that the decision of the Judicial Council in December 2015, which were contained in letters dated January 8 to 11, 2016, purporting to suspend payments to the plaintiffs of all their allowances except rent, was inconsistent in law.
They claimed the move was also in contravention of Article 127(5) of the 1992 Constitution and therefore unconstitutional, null, and void.
But all the five justices of the highest court of the land dismissed the case. They indicated the reasons would be given in seven days.
