Your Behavior Betrays The Office Of Special Prosecutor - Atik Scolds Kissi Agyebeng

Former PNC General Secretary, Atik Mohammed has asked the Special Prosecutor to stop lamenting about the Judiciary and concentrate on his corruption cases ensuring he executes them to the end.

To him, the Special Prosecutor's behavior is unacceptable, stressing if he feels he has strong evidences to back his cases and they are dismissed in court, he has the option of seeking appeal at the Court of Appeal.

He questioned the Special Prosecutor, Kissi Agyebeng's logic in organizing press conferences and complaining about Judges throwing out his cases.

Kissi Agyebeng, speaking to the press on Wednesday, November 29, pointed out some frustrations he is having in prosecuting his cases.

He described the trend as troubling saying "we do not force feed cases, we do not force feed our prosecutions. It is our belief that it is not a matter of us going beyond our mandate but rather a case of hasty dismissiveness and lack of regard because if you take the four cases I tabled out over a period of time spanning from July 2022 to Monday, there is a troubling trend".

He added; “Indeed I have had several calls from well-meaning lawyers admonishing me that they have heard talk that our friends who have been elevated to the bench and presiding over cases in court do not take very kindly to criticism, especially of the public calling out variety as we do. And that if the office persists in the media releases, the judges will gang up against the office and throw out all our cases.

“It will be absolutely of no good should it be the case that the OSP is set against the judiciary or that the judiciary is against the OSP. That will surely spell disastrous consequences for this republic, especially in the fight against corruption to the glee of corrupt persons.”

“I do not intend to sound as though I’m predicting doom but we are facing doom. With this development, it will not be long, [before] a suspected murderer or armed robber will boldly walk to court with the unthinkable prayer that the court should injunct law enforcement agencies from investigating him”, Mr. Agyebeng cautioned.

But to Atik, the utterances and actions of Kissi Agyebeng betray the office of the Special Prosecutor.

"If you strongly believe in your case that what you did was lawful and you were bounced, what do you do? You move up; you don't come and organize a press conference and tell us that there seems to be a grand conspiracy against you. Are you the only one who goes to court? Are you the only person who is a lawyer?", he slammed.

Atik reprimanded the Special Prosecutor stressing "we set up this office for good reason and his behavior and actions are betraying the very objects of this office. We set it up to be able to fight corruption but I can't see any corruption case he has fought successfully to the end".

Delivering his submissions on Peace FM's "Kokrokoo" morning show, he admonished Kissi Agyebeng to up his game and stop the numerous complaints, stating he should seemingly resign if he feels he cannot do his job.

"Is he telling me that he always goes to one court or only one Judge presides over all his cases? It cannot be that all the Judges work in a league to frustrate you alone. Are you the only one leading an anti-corruption agency in this country? The Attorney General, himself, who does even more cases than you is not complaining that there is conspiracy against him...You have no room to lament. He should up his legal game", he said.

Atik further noted that what Kissi Agyebeng is seeking is to get the Judges to favor him but that, to him, is "an invitation to unfairness, injustice".
