Two footballers Amos Ola Tawogbade and Olankunle Olakunji aged 27 and 25 years respectively and residents of Afoaman near Amasaman have been accused of defiling a 9 year old pupil who resides with her father, the complainant.
Chief Inspector Isaac A.A Ahor, who is the Prosecuting Officer in an Accra Circuit Court, gave the statement of offence as conspiracy to commit crime to wit; defilement of a child under sixteen years which is contrary to section 23(1) and 101(1) of Act 29/60.
Nathaniel Amoah 41, a building contractor, residing at Afoaman, who is the complainant, also father of the victim told the court that on 2nd November 2011, after receiving school homework from the victim and her other brother for inspection, he realized to his utter dismay that the victim was not in the house.
This anomaly he said therefore left the complainant with no option than to look for her in the area and after a fruitless search for the victim, he went to bed that he will continue the search the next day.
On 3rd November 2011, the complainant continued the search and in the case of that, he had a phone call from one Robbert to the effect that he had seen the victim with five Ghana cedis in her hand.
The Chief Inspector added that he complainant armed him with this information, returned to the house and interrogated the victim.
The victim during interrogation told the complainant that she was defiled by first and second accused person, the complainant after having obtained this information the victim lodged a complainant with the Amasaman police station.
He (complainant) was issued with police medical report form to send victim to the hospital for examination and treatment.
The complainant later took victim to Amasaman hospital where she was examined and treated with the medical report form which is duly endorsed.
The case was subsequently referred to Tesano Domestic Violence and Victims Support Unit (DOVVSU) for investigation.
Count one of the proceeding states that you (accused persons) on the 2nd day of November 2011 at Afoaman in the Greater Accra Circuit court and within the jurisdiction of the court, did conspire together to commit crime of defilement.
Count two also states for the same date the accused persons did naturally know the victim, aged 9 years.
The case has been adjourned till 13/12/11 for further investigation.
