Preliminary objections raised by the National Media Commission (NMC) in the matter of Samuel Osei Boateng v. NMC were unanimously dismissed by a nine-member panel of the Supreme Court on Wednesday. In the main case, Mr. Boateng is challenging the appointment of Mr. Berfi-Apenteng as Director-General of the GBC by the NMC when he was still a member of the latter body. The court presided over by Justice William Atuguba had its lead judgment read by Dr. Date-Baah with all the others concurring. The NMC in its objection had argued that the High Court was the true and proper forum for the enforcement of human rights and not the Supreme Court. It further argued that Article 168 was clear and unambiguous that there was no need for interpretation of the said article. Thus, the Supreme Court was totally bound by its previous decisions. However, in a unanimous decision, the judges dismissed all three objections completely.
