Error On The Part Of EC Officials Does Not Make The Results Declaration Legal If Illegality Is Detected

Bantama MP, Hon. Henry Kwabena Kokofu has assessed through the cross examination of both counsels for the first and second respondents that as they consistently admitted that there were errors in the whole electoral processes, then they are equally admitting that the 2012 election results are in doubt since the results could have been wrongly calculated and declared. He reminded that the Electoral Commission in its exercise to assess the 2012 elections came out with a report that there were some errors in the electoral processes of which the faults have been leveled against the officials who were contracted; adding that those officials will be prosecuted according to the chairman of the Electoral Commission, Dr. Kwadwo Afari Gyan. Speaking on Okay FM, he said that gradually the court proceedings will finish the first part of the case as the Supreme Court stipulated that the verdict will be based on whether there were irregularities, malpractices and violations of conducts in the 2012 elections. He added that if it is established that the errors which occurred in the form of irregularities, malpractices and violations as it is in the petitioners case to mean over-voting, double pink sheet duplications and not signing of pink sheets, then the next action will be to calculate the errors to check if it affected the 2012 election results which form the second basis upon which the judges will give their ruling. Hon. Kokofu, the Member of Parliament on the ticket of NPP called on Ghanaians to exercise patience because the Supreme Court will soon unravel the truth in the 2012 election results; adding that the figures of the elections results will be audited to know the actual results which should have been declared. According to the lawyer MP, �we are in court because Ghana is still in search of credible electoral process and polls and not selfish interest of Nana Akufo-Addo which is the role of him and that is the real truth�. He said that �error on the part of an official does not make the thing legal if there is illegality�; adding in his own calculation that �evidence of malpractices + statutory violations + irregularities = Gargantuan Errors�. He therefore said that when the court come out with the verdict on the 2012 election litigation, it will be established thereafter that whoever Ghanaians decide to choose as their leader will be respected by all; insisting that the legal vote of the voters must be counted and accounted for and that to him should form the basis of whoever is selected. He again said that after the court case the assembly men elections will be conducted well to provide the right person occupying the position.
