Gbewaa CEO Clashes With Martin Amidu �Over Judgment Debt Defamation Suit

The Chief Executive Officer of Gbewaa Civil Engineering Construction and Petrochemicals Limited, Alhaji Yakubu Adam Kasule a fortnight ago clashed with former Attorney-General and Minister of Justice, Hon. Martin Amidu at an Accra Fast Track High Court over a civil suit instituted against the former by the latter. Mr. Amidu is claiming damages over a purported publication he claims tarnished his image when he was Attorney-General and which he further claims was orchestrated by the Gbewaa CEO when he (Amidu) failed to endorse the payment of Judgement debt initiated by his predecessor, Madam Betty Mould-Iddrisu. Even though Mr. Kasule went to court and won that judgement debt case in August 2012, Hon. Martin Amidu is in court seeking damages for alleged libelous publication against him prior to the court case of January 2012. Led in evidence in court by his lawyer, Albert Adare, Mr. Amidu had averred that on 8th June 2011, Alhaji Kasule wrote a petition to then President John Evans Atta Mills which was later published in the newspapers alleging that he (Amidu) failed to endorse the payment of judgment debt to he (Kasule) because there was an outstanding legal fee which was not paid him when he was solicitor for the latter and as such that publication dented his image in the eyes of the public. But during cross-examination of Mr. Martin Amidu by Kwame Fosu Gyabuor, lawyer for the defendant, Alhaji Kasule had stated that it was he (Amidu) who asked that a letter be written denying Alhaji Kasule of his judgement debt payment. Mr. Amidu denied the charge stressing that that letter did not originate from him and that the Gebwaa CEO had claimed when he was his friend that he (Amidu) once acted as his lawyer with accompanying documents to prove his case but was untrue because that person being referred to in the document is not him. Martin Amidu�s statement caused the judge, Justice Daniel Mensah to quiz � �Are you saying he is not your friend now?� �That was before this law suit,� Martin Amidu replied. That response attracted sharp exchanges between Martin Amidu and lawyer Kwame Fosu Gyabuor compelling the Judge to state that the two should address him and not each other as the bitter confrontation was becoming unbearable and distorting the proceedings. Alhaji Kasule in the ensuing melee got up to respond to a false charge made by Martin Amidu but was prevailed upon by Amicus Curiae (a friend of the court) who was subsequently questioned by the judge why he decided to obstruct the proceedings but after his tactful response, the judge asked that proceedings continue. The case was subsequently adjourned to 24th October 2014 where upon cross-examination would continue.
