The Koforidua High Court has restrained the Nuer family of Somanya from nominating and installing Romeo Tetteh Kofi as the Konor of the Yilo Krobo Traditional Area.
The order followed the granting of an ex-parte motion to a member of the Ologo family, which sought a declaration that any nomination, election or installation of Romeo Tetteh Kofi or any member of the Nuer family as the Konor of Yilo Krobo is void and of no legal effect.
The plaintiff, Divine Tetteh Ologo, who is the deputy head of the Ologo family and a kingmaker of the Yilo Krobo Paramount Stool, is also asking the court for a perpetual injunction to restrain the defendants from the purported nomination and installation of Romeo Tetteh Kofi.
Joined to the action are J. K. Nyumutei and Emmanuel Padi Ologo, both of the Nuer family.
Statement of claim In a statement of claim accompanying the writ, the plaintiff said a dispute arose over successorship, following the death of Konor Narh Dawutey, the Paramount Chief.
The statement said royals from the Ologo and Akrobettoe families had from time immemorial been the only qualified persons to ascend to the stool, but the Nuer family claims that their male family members are also qualified to ascend the stool.
According to the statement, restraining moves were jointly initiated by Joshua Nartey Nuer and Ebenezer Padi Ologo, heads of the Akrobettoe and Ologo families, against the defendants before the Judicial Committee of the Eastern Regional House of chiefs.
It said the principal members of the Akrobettoe and Ologo families were not consulted by Joshua Nartey Nuer and Ebenezer Padi Ologo before they signed a memorandum of understanding (MOU), which was followed by serious disputes.
It averred that the judicial committee wrongly adopted the MOU as consent and the Nuer family nominated and have planned to instal Romeo Tetteh Kofi as Konor of the Yilo Krobo Stool, knowing very well that he is not qualified to occupy the stool.
Affidavit in Support An affidavit in support of the claims said the defendants were planning to organise and hold a coronation of Romeo Tetteh Kofi as the Konor of the Yilo Krobo Traditional Area on April 30, 2015.
“The plaintiff humbly seeks an interlocutory order of this court to restrain the defendants from organising and holding any coronation of the third defendant as the Konor of the Yilo Krobo Traditional Area, pending the final determination of this matter,” the affidavit said.
It said the coronation may result in clashes and end up in violent clashes and commotion, which may affect lives and property, if the defendants were not restrained.
“If the defendants are not restrained, the damage that may be occasioned the plaintiff cannot be remedied by payment of damages,” the affidavit added.
