AUDIO: EC's Decision "Arbitrary, Unfair, Unreasonable, Capricious" - Nana Konadu

The flagbearer of the National Democratic Party (NDP) says she is confident of winning the court case filed against the Electoral Commission (EC).

The NDP and its flagbearer, Nana Kondadu Agyemang Rawlings have filed a suit against the EC for disqualifying them from contesting the upcoming December 7th elections describing the decision to kick the party out of this year's general polls as "arbitrary and unfair".

Nana Konadu Agyeman Rawlings, wife of former President Rawlings, was disqualified by the Electoral Commission for failing to meet some requirements of the electoral laws ahead of the December polls.

She was disqualified together with twelve (12) other presidential aspirants.

“The Commission is unable to accept Mrs. Rawlings’ nomination because the number of subscribers to her forms did not meet the requirements of Regulation 7 (2) (b) of CI 94. One subscriber on page 89 of her nomination forms is not a validly registered voter, and illegally registered twice and so is on the Exclusion list of multiple voters. Details are Salifu Abdulai District: Nanumba South, Voter ID no: 6617004814 (28.3.2012), Voter ID no: 2126900022 (04.8.2014)” the EC explained.

However, the NDP and its flagbearer disagree with the EC and have decided to pursue legal action against the Commission.

Speaking to Kwami Sefa Kayi, Tuesday, on Peace FM morning show 'Kokrokoo', the former First Lady accused the EC of being unreasonable, capricious and unfair; "they didn't tell us there was something wrong with our forms until they collected our money".

"They had called us to rectify an error in our forms; so why didn't they inform us there was something still wrong with our forms so that we will correct it. But they waited until the filing fee was collected before disqualifying us..."

According to her, "we have served them (EC) a copy of the suit and we are waiting for them to respond. I am confident we will win because what they've done is unfair, unreasonable, capricious...."
