Private legal practitioner, Alexander Afenyo Markin has advised his colleague lawyer, Dr. Raymond Atuguba to learn to be a good sportsman by accepting in good faith, cases that don’t go in his favour in court.
According to him, it is hypocritical to want to be a fair-weather friend to the courts in the country and only laud, praise and appreciate them when cases go in their favour, adding that a good lawyer worth his salt will take the losses in his strides, learn from them and use such losses as catalyst to improve and win other cases in the future.
"You shouldn’t be a scorpion sitting on a shivling, be consistent and am directing this at my learned respected colleague, Professor Raymond Atuguba because some of his statements he issued attacking the courts are not proper, are not right and this does not help promote the rule of law’’ he opined in an interview on OkayFM Thursday.
Speaking in an interview with Kwame Nkrumah Tikesie, host of "Adea Akye Abia" Morning Show, Mr. Markin who is also the Member of Parliament for Effutu in the Central Region, took a swipe at the opposition National Democratic Congress (NDC) for usually playing tribal politics with court cases in the country and impugning the integrity of the judiciary.
"They have the penchant for denigrating the courts when they lose cases and politicise most court cases. They berate the courts and judges and insult them and turn around to celebrate them when cases go in their favour. That is absolutely wrong,’’ he said.
Mr. Markin’ comments come in the wake of what he describes as propaganda by some people to twist facts relating to the ruling of the Supreme Court yesterday, which quashed an earlier ruling by a Winneba High Court upholding the removal from office, of the former Vice Chancellor of the University of Education Winneba, Professor Mawutor Avoke.
According to the unanimous ruling, the High Court in Winneba failed to take evidence from the parties in the case before granting judgment.
Mr. Markin further said "most of the time, you find some of our friends in the NDC putting up such a posture, when they win in court, all praises to the rule of law, when they lose in court, they start attacking the court, attacking the institution of state, attacking the individuals who adjudicated or presided, then they begin to say it is because of his tribal background, he is an Ewe or Fante or Nzema or Frafra or Dagomba. Such attitude does not augur well for the country and her laws. So our friends from the NDC who have gained notoriety for that must take a cue and learn. Democracy and the rule of law have no tribal colours."

Whether Atuguba lost the earlier case or not is not relevant any more. The Supreme Court has quashed the judgement that is the most important. Whether Avoke is reinstated or not is not the issue. Atuguba has shown that there was miscarriage of justice that makes him a good lawyer.

Raymond may be good as a lecturer, that does not translate into being a good professional lawyer.for the ***barred word*** ones who have so far contributed, please remember the law is not is not played out like the Champions League. the law evolves.Decisions are over turned all the time.

ATUGUBA LOST THE EARLIER CASE FOR THE REINSTATEMENT OF THE VC IN THE HIGH COURT. THIS RULING DOES NOT MEAN THE VC WILL BE REINSTATED BECAUSE THAT WAS NOT ONE OF THE RELIEFS OF THE FORMER VC/ATUGUBA AT THE SUPREME COURT. ATUGUBA IS NOT BEING PROFESSIONAL HERE...AND HE KNOWS IT.
See who is educating a Harvard Trained PHD holder in law. hahhaaaaa. If you are a lawyer worth your sort we should hear of you when NPP is out of power. Afenyi should understand that prof Atuguba can teach him law in all respect. You never know what the future holds so stop blabbing .
You still don't understand. Dr Atuguba attacked the courts when he lost the first case. He insinuated all kinds of tribal reasons for his loss. However, he is now happy the SC has ruled in his favor (Note: Not on the substantive case of whether Prof Avoke should have been removed or not). Afenyo's case is simple. Why does Raymond Atuguba congratulate the courts when he wins and denigrates them when he loses? Is he entitled to only victories in the courts?

Mr. Alexander Afenyo Markin, your advice is misdirected. Dr. Raymond Atuguba doesn't need your ill advice. He wrote a lengthy article advising the president, you misled, not to participate in the swearing in of the VC and he ignored. Look at the shame this has brought. In any case, why should Dr. Raymond Atuguba accept defeat when he has a constitutional right to seek justice or appeal a lower court decision at the Supreme Court, where those Justices are extremely hard to bribe? You can work your way and influence High Court Judges. You can't succeed at the Supreme Court
Please educate me, what necessitated the dismissal of the former VC of UEW ??? ....and what is your understanding of yesterdays SC Ruling ????? was the VC dismissal based on the High Court ruling ????? am just a layman
