The confirmation of the acting boss of the Commission on Human Rights and Administrative Justice (CHRAJ), Joseph Whittal, has sparked controversy barely five hours after the move.
President John Dramani Mahama on Tuesday December 20, 2016 confirmed Joseph Whittal as the head of CHRAJ while announcing Josephine Nkrumah as the new head of the National Commission for Civic Education - NCCE.
Though the appointments were announced a few hours ago, the president's decision to confirm Mr Whittal as the substantive CHRAJ boss appears to be a decision that may not hold for long following a decision by some persons to challenge the action in court.
A former partner at Ampem Chambers, Gabby Otchere Darko, first hinted on his Facebook wall, the intention of the party to challenge the decision of the outgoing-president in court.
Mr. Otchere Darko says the writ is seeking to 'restrain the defeated president from using his last 16 days to impose on his successor a CHRAJ boss he didn't even want to impose on himself'.
In a related development, Peacefmonline.com can confirm that the New Patriotic Party has challenged the power and authority of the out-going president to make new appointments by filing a suit in court.
The writ was filed on behalf of the incoming government by Lawyer Philip Addison, who confirmed the legal action in an interview a short while ago.
According to him, though going by the letter of the law, an outgoing president has the power to make appointment until the midnight 6th of January 2017, in spirit of the law, it cannot make appointment that will tie the hand of the incoming president.

We need peace and jobs stop the court cases.
Ghana is moving ahead. Away from tic-for-tat of little minds. It is the same book-long that made it possible for Ghana to achieve 1GH:1US . And then the "geniuses" came and mess all over the place... mmmmnn kankai. Ghana is not table-top business wai
THIS IS WHY YOU WILL GO INTO OPPOSITION IN 2020. PLEASE SUE KUFUOR FOR HIS 6TH JANUARY, 2009 DECISIONS. ***barred word*** PARTY. EVERYTHING COURT!
IIgnorantus like you deserve no response because you cannot think in any other alternative way. Its called Retardedd Nonentityy.
...Such commets from people like you shall forever keep NDC in the losing seat because you simply cannot reason even when your brains are swollen. Its like asking a vulgarizer why he is fixing a car tire !
He lives over the moon!!! What do you mean by asking if he lives in Ghana? What at all is wrong with you and the NPP sycophants of a party? It is very laughable that you win power and you think you have the powers over everything and everybody in Ghana....... The fact that there is transitions does not mean government is answerable to any of you. If there was a gentleman agreement does not mean they did anything wrong if this was not made known to any of you. Government is still in section till 7th January when they are required to hand over by law..... This spo-ilt child attitude must end and you and your "only good people and wise citizeen" must stop and wake up......... The decisions have been made, if you have issues all you do is wait and when power is handed you do whatever you have to do and if need be that you prosecute, do it... But this attitude of the NPP as if they are in power and Mahama is doing something evil must stop!!! What kwraaa is this? What at all do you want? I personally abhore this kind of backward comparison......but where was the NPP when Kufuor was doing same some years back..... Better concentrate on the handing over, get the facts right so tomorrow you do not come back accusing them of keeping things away from you.
Think about this, you rent a house, used it for business and make so much money. Landlord children says they want the house back. Because you are bitter, you simply cause further damage to the walls and fitting, but still leaves the house because you must. The house that once provided you with means to be rich. But the house will stand. Because God is now in the equation. God bless Ghana. 1. Last minute Appointments here and there 2. Increases in salaries here and there (What happened to IMF caping the wage bill mantra) 3. #WickedMenAboundInNDC
They have never really have any good thought for GHANA. It is always politics for NDC. Few good men abound in this party. The Battle is Still the LORD's. NDC shall forever be loosers
