Lawyers for the Abelemkpe Branch Manager of Marwako eatery, Jihad Chaaban, have filed an application for disclosure directed at state prosecutors to furnish the defence team with all documents they intend to rely on for their prosecution.
According to Augustine Asafo Adjei, the request if granted, would assist them to put up a more informed defence for their client.
Jihad, 26, is before the court over an assault case.
The accused person is reported to have dipped the head of Evelyn Boakye, an employee of the facility, into blended pepper on February 26, 2017.
According to the prosecution led by Chief Inspector H.A. Hanson, the accused offensively conducted himself when he angrily called the complainant a “prostitute.”
Jihad is facing an additional charge of intentionally and unlawfully causing harm to Evelyn when he reportedly dipped her head in the blended pepper.
At the hearing of the case yesterday at the Abeka District Court in Accra, Chief Inspector H.A. Hanson opposed the application.
But the trial magistrate, Ms. Victoria Ghansah, ordered the prosecution to file their statement in opposition first thing this morning while both parties are expected to return to court at 1:00 pm today for the determination of the latest twist to the Marwako trial.
Meanwhile, the much anticipated further cross-examination of Evelyn Boakye has been shelved.
At the last sitting, the defence lawyers had expressed doubt over the actual substance the accused is alleged to have dipped the face of the victim into.
Augustine had claimed that the substance for which his client has been dragged before the court is a “sauce” but not raw pepper.
He said the material being a mixture of garlic, pepper, onions, ginger and tomatoes could not be described as pepper.

And these lawyers are Ghanaians defending the indefensible? Thoght your sauce will be "tomato puree" but not all that you mentioned including ginger, onion, pepper etc....... You do this calling white black and you go to church on sunday......... All because of "the root of all evils" money!!!
So now is a sauce and not pepper and u claim it was a mixture of garlic, onion, pepper and tomatoes, good case and even if it was only onion do u know how it feels when it splits to ur face to talk of missing all these together and u are there giving us technicalities, infact this guy must not go free at least as a lesson to his fellow expats who threat Ghanaians like gabb***gge

Please stop these gimmicks. Is a sauce meant for consumption or for dipping workers faces into it. Will the accused be comfortable if he and family's faces are dipped into a sauce?
The grinned pepper we eat comprise of salt, onion, pepper & tomatoes. Some even include ginger & garlic yet we call it pepper. Stop the technicalities and face your actions
Eiiii, my learned friends. Are you going to be technical or try to establish the substance of the case? - whether or not there was a criminality. What will the difference between PEPPER AND SAUCE, do the fact that someone had INTENT TO INJURE AND TO DEGRADE. I think the lawyers for the claimant should bring additional charges under the Constitution of Ghana under "INHUMANE TREATMENT" under the Human Rights Provision.
