Lawyers for the Abelemkpe Branch Manager of Marwako eatery, Jihad Chaaban, have filed an application for disclosure directed at state prosecutors to furnish the defence team with all documents they intend to rely on for their prosecution.
According to Augustine Asafo Adjei, the request if granted, would assist them to put up a more informed defence for their client.
Jihad, 26, is before the court over an assault case.
The accused person is reported to have dipped the head of Evelyn Boakye, an employee of the facility, into blended pepper on February 26, 2017.
According to the prosecution led by Chief Inspector H.A. Hanson, the accused offensively conducted himself when he angrily called the complainant a “prostitute.”
Jihad is facing an additional charge of intentionally and unlawfully causing harm to Evelyn when he reportedly dipped her head in the blended pepper.
At the hearing of the case yesterday at the Abeka District Court in Accra, Chief Inspector H.A. Hanson opposed the application.
But the trial magistrate, Ms. Victoria Ghansah, ordered the prosecution to file their statement in opposition first thing this morning while both parties are expected to return to court at 1:00 pm today for the determination of the latest twist to the Marwako trial.
Meanwhile, the much anticipated further cross-examination of Evelyn Boakye has been shelved.
At the last sitting, the defence lawyers had expressed doubt over the actual substance the accused is alleged to have dipped the face of the victim into.
Augustine had claimed that the substance for which his client has been dragged before the court is a “sauce” but not raw pepper.
He said the material being a mixture of garlic, pepper, onions, ginger and tomatoes could not be described as pepper.

You don't even have the right to dip someone's face in clean water(unless you can prove that you were 'baptizing' her,reverend minister!). Saying it's sauce and not pepper does not make your crime less serious. It simply does not wash!

The lawyer is talking as if the magistrate does not know the components of the sauce. She is a woman and has been handling garlic, pepper, onion and all that.
Now you changing pepper to sauce, what you talking about? Sauce with garlic, onion, pepper and tomatoes goes to your eye will be more terrible and serious than just ordinary pepper. You guys should stop arguing to this matter and let the court proceedings taking control over the case. The court should not taking things into consideration and punish the guy, if possible should let him face deportation order.

Asafo Adjei you seem to be over-saucing your defense and playing words instead of living by the facts and evidence. Where is your sauce coming from? Is the the Middle English, middle French or Late Latin or Latin and middle east? Sauce is puree and can be even more potent like the zesty effect it gives. I urge the Plaintiff,s team to object whether is a "shito" sauce or cheese sauce or traditional sauce, is meant to add some zesty effect to the food and therefore should be considered as a dangerous weapon. Evelyn is not an egg but a human in which an inhuman jihadist, Chabaan attacked her by dipping her face in the pepper sauce as a way to punishing her for allegedly attempting to destroy a blender. Please don't rain insults on the lawyer, he want his client to lose the case that is why he is saying it wasn't pepper but mixture of garlic,pepper,onion etc.Pepper,garlic and Onion are all painful so he definitely want to defend is country woman.
If it is as the lawyer is describing then it rather worsens the case because the mixture will be more deadlier n more painful.
